DATA BREACH AND CYBER-LIABILITY: PREPARING FOR LITIGATION (FEBRUARY 27, 2014, SPEAKER – ROBERT SUMNER): Data breaches and liability for losses causes by the breach of sensitive information have garnered a great deal of attention over the past few years. With data breaches at the South Carolina Department of Revenue in 2012 affecting millions of taxpayers and the more recent data breaches at large retailers like Target, data breach is becoming a household phrase. While many discount the true threat associated with cyber-liability, the metrics on data breaches and the costs associated with data breaches are staggering. Empirical data published by private vendors, insurance professionals and government agencies demonstrates the serious nature of data breaches and why companies should devote more time, attention and resources towards managing this ever-growing problem. Our presentation focused on the costs of data breaches, the requirements of data breach statutes and how best to defend a data breach lawsuit in the unfortunate event that litigation arises.
